Revocation of a Power of Attorney in Colorado

Ending a Power of Attorney officially cancels the legal authority you previously granted. In Colorado, court approval is not required as long as you have the mental capacity to do so.

The POA revocation must be in writing. It takes effect once the agent and any third parties receive actual notice, making proper delivery essential.

Colorado Legal Standards for Revoking a POA

Colorado law, outlined in Title 15, Article 14, Part 7 of the Colorado Revised Statutes, provides the legal basis for revoking a Power of Attorney. Under this framework:

  • You may revoke a POA at any time if you have legal capacity.
  • The revocation must clearly specify the POA that is being revoked.
  • A Power of Attorney remains valid until the agent and any third parties receive notice of its revocation.

Written Revocation of a Power of Attorney in Colorado

Colorado does not mandate a specific form. However, a written revocation is required. The document should include:

  • Your full legal name and address
  • A statement revoking the POA and all powers granted under it
  • The date of the original Power of Attorney
  • The agent’s full name
  • The date and your signature

Delivery of the POA Revocation in CO

To be legally effective, the agent and all other relevant parties must receive actual notice of the revocation. This includes banks and other institutions that relied on the original POA.

Hand-deliver the document or send it by certified mail. This guarantees there is proof that the revocation was received.

Colorado Recording Requirements

In Colorado, recording a Power of Attorney revocation is not legally required in most cases.

However, if the original POA was recorded (such as in real estate transactions), the revocation should also be recorded with the same county office.
